Fined for failing to comply with two enforcement notices

A HENLEY in Arden resident has been fined after being prosecuted by Stratford-on-Avon District Council for failing to comply with two enforcement notices.

In sentencing, the Bench confirmed it had given full credit for the guilty plea of Philip Scott of Hunger Hill, Henley-in-Arden, who was fined £2,000 at Coventry Magistrates’ Court on Wednesday, March 16, and ordered to each pay £1,786.22 costs.

He was also required to pay a £190 victim surcharge.

The enforcement notices were issued on May 19, 2017 and were both upheld at appeal by the Planning Inspectorate on March 12, 2018.




The notices related to storage, repair, and maintenance of vehicles from the home address at Hunger Hill and the storage of vehicles on adjoining Green Belt land.

The notices should have been complied with by June 12, 2018.


In mitigation, it was submitted that Scott had recently made considerable efforts to reduce the number of vehicles on the land.

Magistrates said the area in the Green Belt land needed clearing as soon as possible.

The land had been the subject of a previous prosecution for non-compliance with the enforcement notices.

Councillor Anne Parry, the authority’s planning portfolio holder said: “This is an important case that gives local people confidence that when there are serious breaches in planning regulations the district council will act on their behalf when it is right to do so.”
